Terms of Service

§ 1 - Registration

1. To use Haptic, previous registration of the customer is required, in addition to having an active server either by free trial or purchased by means of the provider and Stripe partnership. By registering, the present Terms of Service of the provider are agreed unconditionally. The customer assures that all information provided are true and complete.

2. To register, a valid e-mail address and password are required.

3. To purchase a server, a customer must have registered with the provider, be in good standing with the provider, and provide necessary funds to the provider through Stripe.

§ 2 - Free trial

1. Each customer is entitled to one free trial Duo Server, which is valid for 3 days. After the free trial period, a customer can, if they choose, purchase a server from Haptic on a recurring monthly basis.

2. In order to use our free trial, a customer must have registered with the provider, be in good standing with the provider, and have a confirmed, valid e-mail address.

3. Some limitations exist during the trial period. For example, a customer may not download backed-up game files from the provider, or modify the Message of the Day for any of their game instances while using the free trial.

4. A customer will have full access to everything Haptic offers, including downloading game files and modifying the Message of the Day, once they have purchased a server.

§ 3 - Billing

1. All servers on an account will be billed automatically every month to the credit card associated with a customer account. A customer may cancel any of their servers at any time, and may retain access to said server until the end of the current billing period. After that, said server will be deleted.

2. Haptic, LLC has partnered with Stripe for secure payment processing. A customer's credit card info goes directly to them, and Haptic, LLC only sees the last four digits and the brand for identification purposes.

§ 4 - Prices and payment conditions

1. All prices are retail prices and are in USD and contain the legal sales tax as applicable. For services, the listed prices at the time of order placement are valid.

2. Subscription changes will apply proration discounts when appropriate such as upgrading in the middle of a billing cycle.

§ 5 - Cancellation right for customer

1. A customer has the right to cancel any of their servers at any time. If a server is cancelled, billing for said server will cease at the end of the billing cycle. A server in a cancellation state may be renewed before the end of the billing cycle, which will then continue the billing for said server until it is then cancelled.

§ 6 - Refunds

1. New customers who are unhappy with Haptic can request a refund by contacting Haptic, LLC through Discord. Refunds are not guaranteed for accounts violating these Terms of Service.

§ 7 - Warranty

1. This service is provided "as is" without any warranty. The service is provided on a "best effort" basis and no guarantees are made by the provider as to the continuous availability of the service.

2. The provider undergoes regular maintenance for the reliability of its services. For this purpose, the provider may temporarily disable, limit, or degrade the service. This maintenance will be carried out during off-peak hours whenever possible.

§ 8 - Liability

1. Data communication via the Internet can not be guaranteed to be available at all times without error at the current state of technology. Haptic, LLC is not liable for the continuous or uninterrupted availability of the services. The provider may announce maintenance, support times, and times when the services are not reachable due to technical or other problems, which are not within the control of the provider.

§ 9 - Other essential contractual obligations of the customer

1. The customer is prohibited from using the following services in connection with web spaces and servers provided by the provider: FTP services or any similar services which go beyond the normal level of traffic. The customer shall not host any content that is extremist, mature or pornographic, commercially erotic, violent, racist, discriminating, harmful to children or ethnically offensive content, or content inciting to crime or instructions thereof. This includes content that can be accessed through hyperlinks or other connections that puts the customer on third party sites.

2. The provider may terminate customer's services if they differ from normal operating behavior uses or culpably violates these Terms and Conditions.

§ 10 - Notes for the Haptic customer

1. Not an official Minecraft product. Not approved by or associated with Mojang.

2. Any purchase with the provider is not a sale of any game license such as for Minecraft, Valheim, etc.

3. By agreeing to these Terms of Service, you also agree to abide by the Terms of Service of those companies that provide your game licenses. Connecting to our service with any unlicensed or pirated game is a violation of our Terms of Service.

§ 11 - Privacy Policy

1. By registering with Haptic and using the service, the customer is indicating that they have read, understood, and consented to the provider's Privacy Policy and this Terms of Service.
